ESCAPEGOATAGENT IS STRICTLY A SOCIAL EXIT CONVENIENCE UTILITY DESIGNED FOR SIMULATED, BELIEVABLE PHONE CALL INTERRUPTIONS. It is NOT an emergency dispatch service, 911 proxy, crisis hotline, personal safety system, physical protection service, or medical lifeline. If you or someone around you is in immediate physical danger, experiencing a medical emergency, experiencing domestic violence, or requires law enforcement, you must immediately dial 911 or your local emergency services authority.

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding contract between you ("User", "you", or "your") and EscapeGoatAgent Inc. ("EscapeGoatAgent", "we", "us", or "our"). By downloading, installing, accessing, browsing, or utilizing the EscapeGoatAgent mobile application (the "App"), our web properties at escapegoatagent.com (the "Site"), or any associated telephony and AI voice services (collectively, the "Service"), you expressly agree to be bound by these Terms and our Privacy Policy.
If you do not agree unconditionally to all provisions contained within these Terms, you must not access or use the Service, and you must uninstall the App immediately.
2. Nature of Service & Emergency Disclaimer
2.1 Purpose: EscapeGoatAgent is developed and operated solely as a social exit utility and conversational entertainment tool. It initiates automated, dynamic, interactive synthetic voice phone calls to your verified telephone number to provide a polite, plausible, and socially graceful reason to excuse yourself from uncomfortable, awkward, or non-hazardous social situations (such as tedious business meetings, undesirable dates, or lengthy dinners).
2.2 NOT FOR EMERGENCIES OR ESCORT SERVICES: Under no circumstances does EscapeGoatAgent monitor your physical location, guarantee personal safety, dispatch emergency responders, or provide security protection. You acknowledge and agree that:
The Service is not equipped to contact 911, public safety answering points (PSAPs), police, fire, emergency medical technicians, or roadside assistance.
You will never rely upon EscapeGoatAgent as a substitute for contacting law enforcement or medical professionals during moments of threat, violence, injury, or criminal activity.
EscapeGoatAgent disclaims any duty of care or liability arising from your failure to summon genuine emergency services in a critical situation.
3. Eligibility & Account Registration
To use EscapeGoatAgent, you must:
Be at least 18 years of age (or the age of legal majority in your jurisdiction).
Possess the legal capacity to enter into a binding contract.
Complete authentication using a valid email address and verify a mobile telephone number for which you are the registered subscriber or authorized primary user.
Maintain the confidentiality of your account credentials and immediately notify us of any unauthorized access.
4. TCPA Certification & Phone Number Ownership
4.1 Telephone Consumer Protection Act (47 U.S.C. § 227) Compliance: You explicitly certify, warrant, and represent that any telephone number you register, enter, or submit to the Service is your personal telephone number or a number for which you have received express written consent from the subscriber to receive automated and artificial/prerecorded voice calls.
4.2 Express Consent to Outbound Calls: By scheduling a rescue call or triggering an on-demand ("Rush") rescue call within the App, you grant EscapeGoatAgent express written consent to initiate outbound automated voice calls using an automatic telephone dialing system (ATDS), artificial voice, and prerecorded/synthetic voice technology to your verified phone number.
4.3 Strict Prohibition Against Third-Party Harassment: You are strictly forbidden from entering, scheduling, or targeting phone numbers belonging to third parties without their unambiguous consent. Initiating unsolicited calls to third parties, prank-calling non-consenting individuals, spoofing caller identities, or using the Service for harassment or intimidation constitutes a material breach of these Terms, subjecting you to immediate termination and statutory liability under federal and state law.
4.4 TCPA Indemnity: You agree to fully defend, indemnify, and hold harmless EscapeGoatAgent from any claims, regulatory penalties, fines, costs, or damages arising out of calls placed to a number you provided that was inaccurate, reassigned, or for which you lacked legal authorization.
5. AI Voice Synthesis & Bot Disclosures
Statutory AI Notice (California BOT Act & FCC Compliance): All rescue calls placed by EscapeGoatAgent are generated using synthetic artificial intelligence (AI) voice models and dynamic large language model (LLM) conversational processing.
5.1 California BOT Disclosure (Cal. Bus. & Prof. Code § 17940 et seq.): In compliance with applicable synthetic media and bot transparency statutes, EscapeGoatAgent discloses to you that the voice personas delivering the rescue calls (including personas such as "Angry Boss", "Sick Pet Vet / Sitter", "Crying Nanny", and "Panicked Roommate") are automated artificial intelligence agents, not human callers.
5.2 FCC AI Declaratory Ruling Compliance: Under the Federal Communications Commission (FCC) Declaratory Ruling regarding AI-generated voices under the TCPA, you acknowledge that you are requesting and consenting to an artificial voice communication that you intentionally initiate on your own behalf.
5.3 Accommodating Accomplice / "Pass-The-Phone" Mode: If you hand your phone to a third party during a call ("Pass-the-Phone" / Accomplice Mode), you represent and warrant that doing so is done with full awareness that the caller is an AI simulation. You must not use this feature to fraudulently deceive law enforcement officers, emergency workers, or medical personnel.
6. Wiretapping, Audio Processing & Conversational Consent
6.1 Real-Time Two-Way Audio Streaming: To enable dynamic, natural back-and-forth conversation, when you answer an EscapeGoatAgent rescue call, your live spoken audio is transmitted via telecommunication carriers (Twilio Inc.) to our voice processing sub-processor (ElevenLabs Inc.).
6.2 Processing Pipeline: The live audio stream is converted from speech to text, processed by real-time conversational agents to understand your verbal responses, and converted back into dynamic synthetic voice audio in real time.
6.3 All-Party / Two-Party Wiretap Consent: To the extent state wiretap laws (e.g., California Cal. Penal Code § 632, Florida, Pennsylvania, Massachusetts, Illinois) apply to automated algorithmic analysis of conversational audio streams, you hereby grant your express consent to such real-time automated processing. We do not maintain permanent audio recordings of your conversational phone calls on our production servers; processing is performed ephemerally in volatile memory during the active session.
7. Pricing, Credits, Subscriptions & In-App Purchases
7.1 Free Tier (Onboarding): Every new verified user account receives five (5) free rescue call credits upon successful signup and mobile number verification. Free credits hold no cash value and cannot be transferred or redeemed for legal currency.
7.2 Credit Packs (Consumable IAP):
5-Pack of Rescues: Available for $4.99 USD ($1.00 per rescue call).
Credits are decremented by one (1) credit whenever an on-demand ("Rush") rescue or scheduled rescue is initiated and successfully answered.
Purchased credits do not expire as long as your account remains active.
7.3 Unlimited Subscription:
Monthly Subscription: $6.99 USD per month ("Escape Unlimited").
Provides access to all standard and premium rescue scenarios, immediate Rush Mode, custom scenario variable customization, and unlimited rescue calls subject to our Fair Use Policy (Section 9).
Subscriptions automatically renew every month unless cancelled at least 24 hours prior to the end of the current billing cycle through your Apple App Store account settings.
7.4 In-App Purchases (StoreKit): All payments and recurring subscriptions are processed directly through Apple Inc.'s In-App Purchase mechanism (StoreKit). EscapeGoatAgent does not collect, store, or process your credit card or financial instrument details directly.
8. Failed-Call Credit Guarantee & Refund Policy
🛡️ Failed-Call Credit Protection: If a scheduled or rush rescue call fails to connect, encounters carrier network failure, or fails to reach an answered/connected state, the credit is returned automatically to your balance without penalty.
8.1 Credit Return Trigger: Our backend telecommunications webhook tracks call completion status via carrier delivery receipts (Twilio Status Callback). If the call results in busy, failed, or undelivered, or if the telephony bridge is terminated before the synthetic voice persona connects, your credit will be automatically refunded to your in-app profile.
8.2 App Store Purchases: Because all financial transactions are governed and processed by Apple, refund requests for credit packs or subscriptions must be submitted directly to Apple Support in accordance with Apple Media Services Terms and Conditions (reportaproblem.apple.com).
9. Fair Use Policy (Unlimited Plan)
To maintain service quality, protect telecommunication infrastructure, and prevent automated script abuse, the $6.99/month Unlimited Plan is subject to a fair use threshold of twenty-five (25) completed rescue calls per billing cycle.
Usage exceeding 25 completed calls in a single monthly billing cycle may be flagged for automated abuse review. EscapeGoatAgent reserves the right to rate-limit or temporarily pause outbound calling capabilities on accounts that exhibit programmatic calling patterns, PBX forwarding abuse, or spam behaviors.
10. Acceptable Use & Prohibited Conduct
You agree that you will NOT use EscapeGoatAgent to:
Impersonate law enforcement, federal agents, 911 dispatchers, court officers, or healthcare personnel;
Initiate calls to any telephone number that you do not personally own or have documented authority to direct calls to;
Harass, stalk, threaten, defraud, defame, or intimidate any person;
Execute robocalling campaigns, unsolicited marketing, or commercial telemarketing;
Create scenarios featuring extortion, severe self-harm, threats of violence, hate speech, or terrorist content;
Circumvent or attempt to reverse-engineer any rate limiters, API keys, AI prompts, or backend security protocols;
Use the Service in violation of any applicable federal, state, local, or international law, including the TCPA, CAN-SPAM Act, or state wiretapping statutes.
11. Intellectual Property Rights
The App, Site, visual design, audio prompts, scenario scripts, trademarks, logos, and underlying code are the sole proprietary property of EscapeGoatAgent Inc. and its licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal iOS devices strictly for your personal, non-commercial use.
12. Third-Party Infrastructure & Carriers
You acknowledge that the delivery of rescue calls depends on third-party telecommunication carriers (including Twilio Inc., mobile network operators) and AI voice synthesis infrastructure (ElevenLabs Inc.). EscapeGoatAgent is not responsible for cellular carrier downtime, call screening apps, iOS "Silence Unknown Callers" filtration (unless whitelisted via our provided vCard), or poor signal reception that prevents call delivery.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ESCAPEGOATAGENT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, TIMELY, OR SECURE, OR THAT THE SYNTHETIC CALL WILL CONVINCE ANY THIRD PARTY IN ANY SOCIAL SITUATION.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL ESCAPEGOATAGENT INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, REPUTATION, GOODWILL, DATA, OR SOCIAL STANDING) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ESCAPEGOATAGENT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS ($50.00 USD).
15. Indemnification
You agree to defend, indemnify, and hold harmless EscapeGoatAgent Inc. and its affiliates, officers, directors, and employees from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms or applicable law; (c) any phone number provided by you; or (d) any third-party claims arising from your conduct during or following an EscapeGoatAgent rescue call.
16. Dispute Resolution & Arbitration Agreement
PLEASE READ CAREFULLY: THIS SECTION CONTAINS A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER.
16.1 Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
16.2 Class Action Waiver: YOU AND ESCAPEGOATAGENT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
17. Governing Law & General Provisions
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any principles of conflicts of law. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
Modifications: We reserve the right to revise these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Service after any modification constitutes your acceptance of the updated Terms.
